
This book arose from questions about the legal protection given to marriage in Brazil. Among the elements of the institute, the matrimonial rights, set out in the list of art. 1.566 of the Brazilian Civil Code, were observed.
A bibliographical study revealed the essential nature of matrimonial rights and duties in establishing the institute of marriage. Positivized by Canon Law, they have had a major influence on the formation and dynamics of Western societies, since, in most legal systems and until a few decades ago, marriage was the way in which the so-called legitimate family was formed.
