Synopsis

A Constituição Federal de 1988, em seu artigo 62, caput, prevê que o Presidente da República poderá adotar medidas provisórias, com força de lei, em caso de relevância e urgência. O presente trabalho é resultado de estudos sobre a medida provisória 664/2014 e as mudanças trazidas por ela à Lei de Benefícios (lei 8.213/91) e seus reflexos como uma afronta ao princípio da proibição do não retrocesso social, tema que será amplamente analisado.
